{"id":5052,"date":"2020-04-21T17:44:14","date_gmt":"2020-04-21T21:44:14","guid":{"rendered":"https:\/\/granitestatetaxpayers.org\/gst\/?p=5052"},"modified":"2020-05-10T15:20:26","modified_gmt":"2020-05-10T19:20:26","slug":"nh-superior-court-ruled-that-sb3-is-unconstitutional","status":"publish","type":"post","link":"https:\/\/granitestatetaxpayers.org\/gst\/nh-superior-court-ruled-that-sb3-is-unconstitutional\/","title":{"rendered":"SB3 Requiring Proof of Residency Ruled Unconstitutional"},"content":{"rendered":"<p><strong>NH Superior Court Judge David Anderson has Ruled that SB3 is Unconstitutional.<\/strong><br \/>\nSB3 required that people registering to vote here actually show proof that they are from New Hampshire.<\/p>\n<p><strong><em>Granite State Taxpayers<\/em> Supported SB3 Early and Often.<\/strong><br \/>\n&#8211; <a href=\"https:\/\/granitestatetaxpayers.org\/gst\/superior-court-to-hear-appeal-of-sb3\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong><em>Superior Court to hear Appeal of SB3<\/em><\/strong>, by GST, April 16, 2018<\/a><br \/>\n&#8211; <a href=\"https:\/\/granitestatetaxpayers.org\/gst\/sb3-signed-by-governor-sununu\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong><em>SB3 Signed by Governor Sununu<\/em><\/strong>, by GST, July 14, 2017<\/a><br \/>\n&#8211; <a href=\"https:\/\/granitestatetaxpayers.org\/gst\/talking-points-promoting-sb3\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong><em>Talking Points Promoting SB3<\/em><\/strong>, by GST, May 30, 2017<\/a><\/p>\n<p><strong>The NH Democrat Party and the League of Women Voters quickly brought suit, alleging that SB3:<\/strong><br \/>\n&#8211; violates the NH Constitution by burdening the right to vote (Count I)<br \/>\n&#8211; contradicts the domicile qualification in the NH Constitution (Count II)<br \/>\n&#8211; violates equal protection (Count III)<br \/>\n&#8211; is void for vagueness (Count IV)<br \/>\nOn November 4, 2019, the Court dismissed Count II in its entirety and Count IV in part.<\/p>\n<p><strong>On April 8, 2020, the Court found for the Plaintiffs on Counts I and II, and for the State on Count IV.<\/strong><br \/>\n<a href=\"https:\/\/granitestatetaxpayers.org\/gst\/wp-content\/uploads\/2020\/04\/SuperiorCourtSB3Decision200418.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><strong><em>Click here to read the Superior Court decision on SB3.<\/em><\/strong><\/a><\/p>\n<p><strong>On Count I (Burden), the Court relied on data from observers and officials in Durham and Hanover.<\/strong><br \/>\nSpecifically, observations of registration time of &#8220;specific individuals&#8221;, not on average registration times.<br \/>\nThe Court ignored domicile affidavits dropping from 7.3% of 2016 same day registrants to 2.6% in 2018.<br \/>\nThe Court noted wait times at the busiest NH polling places did not constitute a severe burden on voters.<br \/>\nEvery voter was able to vote, but &#8220;burdens&#8221; imposed by SB3 were ruled &#8220;unreasonable and discriminatory&#8221;.<br \/>\n<strong>The Court said efforts to educate voters about SB3 showed that SB3 imposed a burden on voters.<\/strong><\/p>\n<p><strong>On Count III the Court said SB3 denied Equal Treatment, as it applies to Same day Registrants.<\/strong><br \/>\nPlaintiffs argued &#8220;young voters, college students, mobile voters, low-income voters, and Democrats are more likely to be impacted by SB3.&#8221; because they have an &#8220;increased rate of same-day registration.&#8221; <\/p>\n<p><a href=\"https:\/\/granitestatetaxpayers.org\/gst\/new-hampshire-citizens-should-decide-new-hampshire-elections\/\" rel=\"noopener noreferrer\" target=\"_blank\"><strong><em>GST has long advocated for reform of New Hampshire Election Laws.<\/em><\/strong><\/a><br \/>\nGST supports legislation so that people who vote in New Hampshire actually live in New Hampshire.<\/p>\n<p><strong>SB3 is more permissive than the laws in Massachusetts and most other states.<\/strong><br \/>\nSB3 would allow one to vote and bring their proof of residency later.<br \/>\nIn Massachusetts, you aren&#8217;t allowed to vote if you don&#8217;t provide proof of residency.<br \/>\n<strong>Democrats haven&#8217;t sued the State of Massachusetts, only New Hampshire. <a href=\"https:\/\/granitestatetaxpayers.org\/gst\/dems-sue-for-out-of-state-voters\/\" rel=\"noopener noreferrer\" target=\"_blank\"><em>Click to read why.<\/em><\/a><\/strong><\/p>\n<p><strong>The State plans to appeal Judge Anderson&#8217;s decision to the New Hampshire Supreme Court.<\/strong><\/p>\n<p>Posted by <em>GST<\/em> Chairman Ray Chadwick<\/p>\n","protected":false},"excerpt":{"rendered":"<p>NH Superior Court Judge David Anderson has Ruled that SB3 is Unconstitutional.
