{"id":5364,"date":"2020-05-25T01:56:48","date_gmt":"2020-05-25T05:56:48","guid":{"rendered":"https:\/\/granitestatetaxpayers.org\/gst\/?p=5364"},"modified":"2020-05-25T01:57:52","modified_gmt":"2020-05-25T05:57:52","slug":"democrats-cut-state-funding-for-defense-against-their-lawsuits","status":"publish","type":"post","link":"https:\/\/granitestatetaxpayers.org\/gst\/democrats-cut-state-funding-for-defense-against-their-lawsuits\/","title":{"rendered":"Democrats Cut State Funding for Defending Against their Lawsuits"},"content":{"rendered":"<p><strong>The NH Democrat Party and allies <em><a href=\"https:\/\/granitestatetaxpayers.org\/gst\/dems-sue-for-out-of-state-voters\/\" rel=\"noopener noreferrer\" target=\"_blank\">sued the State to overturn HB 1264 and SB 3<\/a><\/em>.<\/strong><\/p>\n<p><strong>The State&#8217;s Attorney General has the constitutional duty to defend the state and it\u2019s laws.<\/strong><br \/>\nThat includes laws passed by previous legislatures, including election laws enacted by SB 3 and HB 1264.<\/p>\n<p><strong>Democrats in the Legislature don&#8217;t want the State is defending against their Party&#8217;s lawsuits.<\/strong><br \/>\nRecently, Democrats on the Joint Fiscal Committee voted to cut Attorney General\u2019s litigation fund.<br \/>\nThe intent was to eliminate funds needed to defend HB 1264 and SB 3 against the Democrat Party lawsuits.<\/p>\n<p><strong>This effort to hamper the State&#8217;s ability to defend these laws goes back to January 2020.<\/strong><br \/>\nOn January 10, 2020, Joint Fiscal Committee Democrats rejected an AG request for general litigation funds.<br \/>\nThey said they &#8220;<em>voted to cease funding for two cases which put voting rights of Granite Staters in jeopardy.<\/em>&#8221;<\/p>\n<p><strong>The Attorney General issued a January 16, 2020 letter <em>(<a href=\"https:\/\/granitestatetaxpayers.org\/gst\/wp-content\/uploads\/2020\/05\/5-8-20_Additional_Information.pdf\" rel=\"noopener noreferrer\" target=\"_blank\">click here to read it<\/a>)<\/em>, making these points:<\/strong><br \/>\nA statute enacted expressed the policy of the State made by the people through elected representatives.<br \/>\nThe Attorney General is obliged to defend any duly enacted statute against any constitutional challenge.<br \/>\nThe product of the legislative process is presumed to be constitutional and the AG policy is to defend it.<br \/>\nThe Attorney General has no discretion to pick and choose which statutes to defend.<br \/>\nThat a legislative majority could control or interfere with litigation raises serious concerns.<\/p>\n<p><strong>We know that Democrats have a major interest in having non residents voting in New Hampshire.<\/strong><br \/>\nThey bring lawsuits to try to void laws that the NH Supreme Court has declared constitutional.<br \/>\nNow they&#8217;re working to eliminate funding that enables the State to defend against their lawsuits.<\/p>\n<p><strong>This year we need to elect a Legislative majority in Concord that protects NH voters instead of itself!<\/strong><\/p>\n<p>Posted by <em>GST<\/em> Chairman Ray Chadwick<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The NH Democrat Party and allies sued the State to overturn HB 1264 and SB 3.
