How about non-resident NH Legislators?"},"content":{"rendered":"<p><strong>We all know that before HB1264 and SB3, NH laws allowed residents of other states to vote in NH.<\/strong><br \/>\nNH is unique in doing so as 49 states and DC require voters to be residents and prove they are.<br \/>\nOut of state residents registering on election day and then voting in NH get most of the attention.<br \/>\nThat practice is the cause of most claims of &#8220;massive voter fraud&#8221; in New Hampshire.<br \/>\nBut that practice had been legal under NH law allowing residents of other states to vote in NH. <\/p>\n<p><strong>NH laws also allowed residents of other states to be run for, and be elected to, office in NH.<\/strong><\/p>\n<p><strong>In 2018, Dartmouth student Garrett Muscatel was elected to the NH House using his dorm address.<\/strong><br \/>\nHe was also a plaintiff in the <em><strong><a href=\"https:\/\/mediad.publicbroadcasting.net\/p\/nhpr\/files\/201708\/complaint_for_declaratory_and_injunctive_relief.pdf\" rel=\"noopener noreferrer\" target=\"_blank\">League of Women Voters lawsuit filed 8\/23\/17 against SB3.<\/a><\/strong><\/em><br \/>\nThe complaint states that Muscatel was <strong>domiciled in<\/strong> Hanover, New Hampshire.<br \/>\nThe complaint also states that he &#8220;currently temporarily&#8221; <strong>resides in<\/strong> Thousand Oaks, California.<br \/>\n<em><strong><a href=\"https:\/\/b9855d0b-3c11-4c17-964b-9f12435a501f.filesusr.com\/ugd\/696cec_ebdef20a72724e66a5c1ea9dc3fdd475.pdf\" rel=\"noopener noreferrer\" target=\"_blank\">(The NH Democrat party had also filed suit against SB3 on 8\/22\/17.)<\/a><\/strong><\/em><br \/>\nWhen Dartmouth dorms closed due to Corona, he went home to Thousand Oaks, California.<br \/>\nThen <em><strong><a href=\"https:\/\/knight-hennessy.stanford.edu\/program\/scholars\/2020\/garrett-muscatel\" rel=\"noopener noreferrer\" target=\"_blank\">Stanford University announced<\/a><\/strong><\/em> Muscatel, from Thousand Oaks, CA, had been accepted there.<\/p>\n<p><em><strong><a href=\"https:\/\/www.wmur.com\/article\/nh-primary-source-nhgop-raises-residency-question-about-young-state-lawmaker-voting-activist\/32713729\" rel=\"noopener noreferrer\" target=\"_blank\">The NH Republican Party stated<\/a><\/strong><\/em> that, with no NH address, Muscatel couldn&#8217;t remain in the House.<br \/>\nState law says legislators remain qualified to hold office only if they remain an inhabitant of their district.<br \/>\n<em><strong><a href=\"http:\/\/www.gencourt.state.nh.us\/rsa\/html\/LXIII\/655\/655-8.htm\" rel=\"noopener noreferrer\" target=\"_blank\">Per NH law<\/a><\/strong><\/em>, legislators lose their qualification for office if they no longer inhabit their district.<br \/>\nMuscatel initially stated he was still an inhabitant of NH, <em><strong><a href=\"https:\/\/www.wmur.com\/article\/democratic-rep-muscatel-resigns-nh-house-seat-after-questions-raised-about-his-residency-in-state\/32813789\" rel=\"noopener noreferrer\" target=\"_blank\">but finally was forced to resign.<\/a><\/strong><\/em>.<\/p>\n<p><strong>In 2008, Dartmouth student Vanessa Sievers was <em><a href=\"https:\/\/www.nytimes.com\/2008\/11\/13\/us\/13hampshire.html\" rel=\"noopener noreferrer\" target=\"_blank\">elected as Grafton County Treasurer.<\/a><\/em><\/strong><br \/>\nThe part-time Treasurer manages funds and investments and makes payments ordered by commissioners.<br \/>\nSievers, a resident of of Big Sky, Montana, <em><strong><a href=\"https:\/\/www.bozemandailychronicle.com\/news\/defeated-county-treasurer-blames-college-studen%20ts\/article_6a16a965-930c-5bc8-a61c-95d20dbcd84d.html\" rel=\"noopener noreferrer\" target=\"_blank\">was elected to the the $6,480 job<\/a><\/strong><\/em> by 600 votes out of 42,000 cast.<br \/>\nAfter losing, the former Treasurer stated &#8220;It was the brainwashed college kids that made the difference.&#8221;<br \/>\nSievers began missing County Board meetings, and couldn\u2019t sign checks, when home on break.<br \/>\n<em><strong><a href=\"https:\/\/www.laconiadailysun.com\/news\/local\/dartmouth-student-grafton-treasurer-tries-to-ge%20t-on-same-page-with-lawmakers\/article_48c0b08a-0807-53da-bfa7-73d4bb5c2e6d.html\" rel=\"noopener noreferrer\" target=\"_blank\">After non-binding votes for her resignation<\/a><\/strong><\/em>, Sievers got family members to agree to visit her during school breaks so she could avoid returning home four times a year, which she said \u201cwill help out a lot.&#8221;<\/p>\n<p><strong>NH laws enabled residents of other states BOTH to vote here and hold office here.<\/strong><br \/>\nThat&#8217;s what we&#8217;ve been fighting to fix through our efforts in 2017 to pass and thereafter to sustain:<br \/>\nSB3 (requiring proof of residence when registering) and HB1264 (requiring voters to be residents).<\/p>\n<p>Posted by <em>GST<\/em> Chairman Ray Chadwick<\/p>\n","protected":false},"excerpt":{"rendered":"<p>We all know that before HB1264 and SB3, NH laws allowed residents of other states to vote in NH.
