Arizona may be 2,000 miles from New Hampshire, but the U.S. Supreme Court\u2019s ruling on the Grand Canyon state\u2019s election laws will be felt in Concord. In particular, the decision is yet another blow against congressional Democrats\u2019 attempts to use federal power to override state control of election laws.<\/p>\n

Thursday\u2019s 6-3 ruling in Brnovich v DNC<\/a> struck down challenges to Arizona\u2019s laws requiring election officials to discard ballots cast at the wrong precinct; and banning the practice of \u201cballot harvesting,\u201d in which political parties and activist groups collect ballots from voters and deliver them to polling places. Democrats claimed Arizona\u2019s rules are \u201crestrictive\u201d and discriminate against people of color.<\/p>\n

Justice Samuel Alito, writing for the majority, undermined the often-used argument that any restriction on voting is a form of \u201cvoter suppression\u201d and should be viewed as a violation of the federal Voting Rights Act.<\/p>\n

\u201cThe size of the burden imposed by a challenged voting rule is highly relevant,\u201d Alito wrote. \u201cVoting necessarily requires some effort and compliance with some rules; thus, the concept of a voting system that is \u2018equally open\u2019 and that furnishes equal \u2018opportunity\u2019 to cast a ballot must tolerate the \u2018usual burdens of voting.\u2019 Mere inconvenience is insufficient.\u201d<\/p>\n

The New Hampshire Secretary of State\u2019s office praised the decision.<\/p>\n

\u201cToday\u2019s Supreme Court ruling upholding Arizona election laws banning ballot harvesting is a win for the average voter who wants to exercise their right to vote independently and privately without pressure or influence being applied by political parties or special interest groups,\u201d said Deputy Secretary of State David Scanlan. \u201cThis ruling is consistent with the provisions in New Hampshire\u2019s state constitution and reinforces the serious concerns expressed over provisions in the failed federal legislation known as HR 1 \/ S 1.\u201d<\/p>\n

All four members of the New Hampshire federal delegation voted in favor of H.R.1\/S. 1, also called the For The People Act. All four also declined to respond to requests for comment on the Supreme Court\u2019s ruling.<\/p>\n

The case began in 2016 when the Hillary for America committee teamed up with the Arizona Democratic Party, the Democratic National Committee (DNC), and others asked the courts to force Arizona to allow ballot harvesting and count miscast votes. Like supporters of HR1, they argued federal law stripped Arizona voters from having laws like these on the books. The fact that Arizonans supported these laws didn\u2019t mean they should be allowed to have them, the Hillary Clinton campaign argued.<\/p>\n

\u201cWe\u2019re disappointed in the Court\u2019s ruling today, but we will continue to work to make sure every voter\u2019s vote is counted and protected,\u201d the DNC said in a statement Thursday. \u201cThis ruling is exactly why we urgently need to take action at the state and federal levels to protect voters from Republicans\u2019 unprecedented efforts to undermine the right to vote.\u201d<\/p>\n

President Joe Biden called the decision \u201cdeeply disappointing,\u201d and he said it \u201cupholds what Justice Kagan called \u2018a significant race-based disparity in voting opportunities.’\u201d<\/p>\n

However, Biden\u2019s own Solicitor General\u2019s office<\/a> conceded the Arizona law as allowable under the federal Voting Rights Act.<\/p>\n

State Sen. Regina Birdsell said the ruling \u201chelps solidify the fact that states can run our own election, a fact that runs afoul of H.R. 1 \u2014 which is a good thing.\u201d<\/p>\n

Birdsell opposes ballot harvesting and supports New Hampshire\u2019s current, very narrow law allowing a minimal amount of ballot collection. (Delivery agents in New Hampshire are restricted to immediate family members or nursing home administrators, and the number of ballots they can deliver is severely limited.)<\/p>\n

\u201cI understand that in some very limited situations when a family member is sick, that person should be able to vote,\u201d Birdsell said. \u201cI just don\u2019t want it to be the camel\u2019s nose under the tent that allows ballot harvesting.\u201d<\/p>\n

State Senate Minority Leader Donna Soucy (D-Concord) released a statement declaring, \u201cThe future of our democracy is in peril\u201d \u2014 strong language in response to a ruling on ballot harvesting and miscast ballots. Soucy did not respond to requests that she clarify her remarks.<\/p>\n

Longtime court watcher Carrie Severino of the Judicial Crisis Network noted that Arizona (and New Hampshire) aren\u2019t alone when it comes to miscast ballots. \u201cArizona\u2019s provisions are not outliers. Over two dozen states\u2014including Connecticut, Delaware, and Illinois\u2014have measures like Arizona\u2019s that limit voting outside a voter\u2019s own precinct.\u201d<\/p>\n

And, Severino added, \u201cArizona\u2019s out-of-precinct policy and ban on ballot harvesting are consistent with Section 2 of the Voting Rights Act.<\/p>\n

\u201cSection 2\u2019s purpose of eliminating racial discrimination is extremely important, but the Arizona measures are not discriminatory. Both provisions help make it easy to vote and hard to cheat.\u201d<\/p>\n
